Safe & Sound Home Services
Welcome. These Terms of Service (“Terms”) are the agreement between you and Safe & Sound Home Services (“we,” “us,” “our”) when you use our website (safeandsoundhs.com), request a quote, or hire us for services. We’ve written this in plain language so you (or the family member helping you) can actually read it. Please read it carefully and keep a copy for your records.
By using our website or our services, you agree to these Terms. If you do not agree, please do not use the site or hire us for services.
1. About our services
Safe & Sound Home Services is a North Carolina limited liability company based in Leland, NC. We provide preventive, non-medical home safety services on a subscription basis to homeowners aging in place in Brunswick County and New Hanover County, North Carolina.
A typical membership includes scheduled home safety walkthroughs, minor in-scope adjustments, and written documentation of every visit. The specific services you receive are described in your quote, work order, service agreement, or membership enrollment (“Service Documents”). If anything in the Service Documents conflicts with these Terms, the Service Documents control for that specific job.
2. Who can use our services (eligibility)
To use our website or hire us, you must:
- Be at least 18 years old.
- Be located in the United States.
- Be the homeowner, or have the homeowner’s clear, documented authorization to act on their behalf.
We currently serve homes located in Brunswick County and New Hanover County, North Carolina. We may decline service for properties outside this area.
If you are coordinating on behalf of an aging parent or relative, please tell us so when you reach out. We may ask the homeowner to confirm your authority before we begin work or share information.
3. Quotes, accounts, and bookings
- Quotes. Quotes are good for 30 days from the date issued unless we say otherwise in writing.
- Booking. A booking is confirmed once you accept a written quote or membership enrollment and we acknowledge it.
- Account information. If you create a membership, please keep your contact information current so we can reach you for scheduling, reminders, and safety matters.
- Access to the home. You agree to give us safe, reasonable access to the home at the scheduled time.
4. Membership and subscription billing
Our Founding Member program (and any other membership we offer) is a recurring subscription. By enrolling, you authorize us, through our payment processor Stripe (provided via GoHighLevel), to charge your payment method on a recurring basis.
- Billing: Memberships are billed monthly in advance. Your price is stated in your Service Documents at the time of enrollment.
- Auto-renewal: Memberships continue month to month until canceled.
- Price changes: Founding Member rates are locked under the terms of your service agreement. For non-founding pricing, we will give at least 30 days’ advance notice by email before any increase.
- Failed payments: If a charge fails, we will attempt to reach you, and membership benefits may be paused until billing is current.
- Taxes: Prices do not include applicable sales tax, which will be added where required.
5. Cancellation and refunds
You may cancel your membership at any time with 30 days’ written notice, as described in your Founding Member Service Agreement. Cancellation takes effect at the end of the notice period, and we do not provide prorated refunds for a partial billing period. Specific cancellation, rescheduling, and refund terms are governed by your Service Documents, which control if they differ from this summary.
6. Payment
- We accept payment through Stripe (via GoHighLevel). By providing payment information, you confirm you are authorized to use that payment method.
- Invoices for any non-membership work are due as stated on the invoice.
- Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum rate allowed by North Carolina law, plus reasonable collection costs.
7. Our work in your home — important safety and liability disclosures
We take seriously that we are often working in the homes of older adults. Please read this section carefully.
- Insured. We carry general liability insurance.
- Scope. We perform preventive, non-medical home safety work only. We do not perform emergency or same-day work, and we do not perform any work that requires a licensed electrician, plumber, HVAC technician, or general contractor, structural modifications, renovations, or permit-required work. When we identify something outside our scope, we stop and refer you to an appropriate licensed professional.
- Pre-existing conditions. Many homes have hidden conditions that cannot be known before work begins. If we discover something that affects safety or scope, we will contact you before proceeding.
- Regulated hazards. If we reasonably suspect asbestos, lead-based paint, mold, or similar regulated hazards, we will stop work and recommend testing or remediation by a licensed specialist. We do not perform abatement.
- Medical and mobility status. We are not medical professionals. Our work supports safer living at home but is not a substitute for advice from a doctor, occupational therapist, or other licensed clinician.
- Personal belongings and pets. Please secure valuables, medications, fragile items, and pets before our visit.
- Emergencies. Our services are not an emergency response, medical alert, or monitoring service. In an emergency, call 911.
Limitation of liability
To the fullest extent allowed by North Carolina law:
- Our total liability to you for any claim arising out of these Terms or our services will not exceed the total amount you paid us during the 12 months before the event giving rise to the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost income or loss of use.
- Nothing in these Terms limits liability that cannot be limited under North Carolina law, including liability for gross negligence, willful misconduct, fraud, or personal injury caused by our negligence.
Liability relating specifically to your membership is further addressed in your Founding Member Service Agreement.
8. Warranty
- We warrant our workmanship for 90 days from the date the work is completed. If something we installed fails because of our workmanship during that period, we will repair or replace it at no charge to you.
- Manufacturer warranties on products we install (grab bars, lighting fixtures, etc.) are passed through to you, and we will help you submit a claim if needed.
- This warranty does not cover damage caused by misuse, accident, alterations by others, normal wear and tear, or events outside our control.
- Except for the express warranty above, we disclaim all other warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose, to the fullest extent allowed by North Carolina law.
9. Communications
By providing your contact information, you agree that we may contact you about your service by email, by phone, and, with your consent, by text message, as described in our Privacy Policy. You can opt out of marketing emails at any time, and you can reply STOP to opt out of text messages.
10. Website use and intellectual property
- The content on safeandsoundhs.com, including our name, logo, photos, written guides, and downloads, is owned by Safe & Sound Home Services or licensed to us, and is protected by copyright and trademark laws.
- You may view, download, and print our content for your own personal, non-commercial use.
- You may not copy, redistribute, modify, or use our content for commercial purposes without our written permission.
- We welcome you to share links to our pages and to email our free guides to family members or friends.
11. Your conduct
When using our website or our services, please do not provide false information, harass our team, interfere with the site’s operation or security, or use our services to violate any law. We may refuse, suspend, or terminate service if we believe you have violated these Terms or treated our team unsafely.
12. Third-party services
Our website and services rely on third-party platforms (such as Cloudflare, Google, Meta, GoHighLevel, and Stripe). Their services are governed by their own terms and privacy policies. We are not responsible for the acts or omissions of those third parties.
13. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules.
If you have a concern, please contact us first using the information below and we will work in good faith to resolve it within 30 days. Any dispute that cannot be resolved informally will be handled in the state or federal courts located in Brunswick County, North Carolina, and both parties consent to the jurisdiction of those courts. Either party may also bring a qualifying claim in small claims court.
14. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will post the updated Terms on our website with a new “Last updated” date and, for current customers, send notice by email. Your continued use of the site or services after the change takes effect means you accept the updated Terms.
15. Miscellaneous
- Entire agreement. These Terms, together with your Service Documents and our Privacy Policy, are the entire agreement between you and us regarding our services.
- Severability. If any part of these Terms is found unenforceable, the rest will remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of that provision.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or in connection with a sale of the business.
